Generally, when defendants are arrested for DUI they face two separate proceedings: (1) a criminal case in court and (2) a civil administrative case with the Department of Motor Vehicles. There are several different types of DUI offenses and prior DUI convictions substantially increase the penalties. As a result, it is very important that you understand DUI law the first time you are arrested and do what you can to avoid or minimize the damage on this offense as well as avoiding future arrests.

DUI is one of the most common crimes people hire a lawyer to defend. Every year it seems like there are harsher DUI laws and more serious penalties. A substantial amount of California case law exists on DUI, and there have been numerous legal challenges. All cases are different and each must be evaluated on its own merits, because the statutes and case law are constantly changing and there are many new areas to challenge and fight all the time. Whatever you do, please DO NOT PLEAD GUILTY without having your case reviewed by an experienced DUI lawyer. How Do You Find a Very Good DUI Lawyer?

It may seem difficult to select a DUI lawyer at first, and we caution you against retaining the first attorney you meet. There are many attorneys who do not limit their practice to criminal and DUI cases, and some of these lawyers only handle a few cases a year. Some other attorneys may be incompetent or inexperienced.

To find a good DUI lawyer, we suggest that you ask the following questions:

1. Does your firm have attorneys who are highly experienced in defense of criminal and DUI cases?

2. Does your firm have attorneys who limit their practice to criminal and DUI defense?

3. Does your firm have access to the State's most experienced expert witnesses on the forensic testing of blood and breath alcohol?

4. Does your firm make promises as to the results that they can obtain? Beware -- this is something an ethical lawyer cannot do. Specific results cannot be accurately predicted.

5. Does your firm use a written flat fee agreement that includes trial if necessary? Or is the "fee" only a low initial retainer that only covers part of the case and does not include the DMV hearing? What are the hidden fees?

6. Will your DUI lawyer actually handle the case or will you simply sign me up and hand your case off to a low level associate or worse yet, refer me to another attorney or firm?

7. Can your firm provide recent trial results?

We believe in an aggressive defense. We feel this is necessary because California’s DUI statutes are zealously enforced and provide substantial punishments. We are dedicated to protecting individual rights. We will not recommend that a client plea guilty to DUI unless, after our investigation, we believe such a plea would be in our client's best interest.
